Terms and Conditions of this Auction

Michigan Auction Sales (the Auction Company), conducts auctions, liquidations and other capital asset disposition services via online Webcast and via live bidding to You (The Bidder, and our consignor, The Seller), subject to the following Terms and Conditions, which may be updated by us from time to time without notice to you. You can review the most current version of the Terms and Condition of this auction at anytime via our current online auction website. In addition, when using any of our services, you shall be subject to any posted guidelines, rules, and/or policies and procedures applicable to such services, which may be revised from time to time. All such items are hereby incorporated by reference into the Terms and Conditions of this auction.

All rights, privileges and powers reserved or granted to the Auction Company in these Terms and Conditions of this auction shall be deemed reserved and granted to the Auction Company's employees, representatives, and all Sellers for whom the items are being sold.

This agreement shall be governed by the laws of the State of Michigan without regard to its conflict of law provisions. The Bidder, The Seller and The Auction Company all agree to submit to the personal and exclusive jurisdiction and venue of the courts located within the City of Holt, in the County of Ingham, and in the state of Michigan

  1. Any failure of The Auction Company to exercise or enforce any right or provision of the Terms and Conditions of this auction shall not constitute a waiver of such right or provision.

  2. If any provision of the Terms and Conditions of this auction is found by a court of competent jurisdiction to be invalid, all parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and all of the other provisions of the Terms and Conditions of this auction shall remain in full force and effect. Bidders and Sellers agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms and Conditions of this auction must be filed within one (1) year after such claim or cause of action arose or be forever barred.

  3. In no event shall the Auction Company's liability to The Bidder exceed the purchase price actually paid. A Buyer's claim shall be limited to the amount paid for the merchandise, and shall not extend to any obligation; risk; liability; right; claim; remedy for loss of use, revenue or profit; liability of Buyer to any third party; personal injury; or any other direct; indirect, incidental or consequential damages.

  4. This auction is only available to people who are legally able to form binding contracts. Persons who are under the age of 18 are not eligible to bid or otherwise participate in any of our auctions due to state laws concerning the age of majority.

  5. In order to participate and bid in this Auction event, you, The Bidder, must read and accept all of the Terms and Conditions of this auction completely. Once you place a bid, you are electronically signing and consenting that you have read and accepted all of the Terms and Conditions set forth in this agreement completely, and without exception. By placing any bid on any item(s), you are entering into a legally binding and irrevocable contract with the Auction Company to purchase the particular item(s) in accordance with the Terms and Conditions Of Auction. Once a bid is placed, it can not be canceled or retracted for any reason.The  auction has  a progressive  10 minute  addition to all items  with a $3  or higher bid  beginning at 9:10 pm Which means  all items  with  a $3  or higher bid  will  get  an extended 10 minutes  for under bidders  to  bid again  every bid  thereafter will extend that item  by 10 minutes.  giving all others a chance to bid again.  Please  watch closely after 9:10 pm  to ensure you win items  you want.

  6. You are solely responsible for maintaining the confidentiality of your username and password, and you are fully and solely responsible for all activities that occur under your username, password, or on your account. You agree to immediately notify the Auction Company of any unauthorized use of your username and password or account or any other breach of security, and ensure that you properly log-out and exit from your account at the end of each session. The Auction Company cannot and will not be liable for any loss or damage arising from your failure to comply with this section. Bids can not be canceled or retracted under any circumstance.

  7. There is a 10% buyers premium charged and collected from all bidders and all purchases of all items.

  8. All items are being sold in "as-is", "where-is" condition with all faults and amenities and with no expressed, written or implied warranty. No guarantee is made that any specific item is suitable for any particular use or purpose. The condition and location of each item must be completely satisfactory to the Bidder, whether seen or unseen, before placing a bid. Some items are available for inspection by the Bidder during our normal business hours. While all lots are described as accurately as possible, Bidders are urged to inspect items themselves and to not rely on any description provided by the Seller, nor the Auction Company. The only exception to this is that if you believe an item has been misrepresented or improperly described and that misrepresentation or improper description is material to the value of the item, and the Auction Company agrees with you, you will then be permitted to return that item to the Auction Company for a full refund within 7 calendar days, in the same condition in which the item was sold. No refunds, allowances or exceptions will be made for any item after 7 calendar days. We can not and will not afford any protection to buyers who do not pick up their items during the regular pick-up period specified. In otherwords, if you are late picking up your order, you will not be permitted to return any item since we can not hold the sellers monies waiting for a late buyer pickup, and we will have already paid the seller.

    All items should be checked at time of pick-up and any damaged, missing or broken items must be shown to the Auction Company before the item leaves our premises! No refunds will be given for damaged, missing or broken items after they leave our premises. All decisions to offer refunds are at the sole discretion of the Auction Company.

  9. All items have a minimum bid of $3.00. Unless it is $1 week. Every seller is allowed 3 items per week at higher than $3 or with reserve. Auction House  has right to  Start bids  higher  for  sellers at discresion.

  10. Items won must be picked up from the Auction Company  on  Thursday or  Friday between 11am - 6pm and Saturday between 11am and 3pm immediately following the auction end, .

  11. There is a 20% storage/late payment charge, with a minimum of $5 per invoice, which applies to all Bidders, unless a Bidder can pick-up their items on or before 3pm on the Saturday immediately following the auction end. If a Bidder is unable to pickup their items by this time, that Bidder will be assessed the 20% storage/late payment charge, with a minimum of $5 per invoice. This fee will again be assessed each Sunday where those items are still not removed. If a Bidder is having their items shipped to them, they must pay for their items and arrange for shipping prior to 3pm on Saturday. We do not automatically charge a bidders credit card until after 3pm on the Saturday immediately following the auction end and we may either ship or hold the items.

    We are an auction company, not a storage company and we will not store items for people cheaply. Additionally, we pay out to our consigners weekly for all items sold. This storage/late payment charge is in place to offset the costs associated in paying out money that we haven't yet received and for storing and warehousing items that we have no interest in storing or warehousing. There are no exceptions to this storage/late payment charge whatsoever, for anyone. All we ask is that you please pick up your items on time, we do not want you to have to pay a storage/late payment charge, we merely want to see your items picked up and paid for on-time.

  12. If an item(s) is not removed within 2 weeks, a final $25 disposal fee will be charged to the Bidder on the 3rd week and any and all item(s) will be considered abandoned by the winning Bidder and will be disposed of however the Auction Company sees fit, although, the Bidder will still be liable to the Auction Company for full payment for the cost of all items won, as well as all past storage/late payment charges incurred, disposal fees, as well as all cost incurred in collecting these monies due, including all legal fees and any other costs that are incurred by the Auction Company in collecting these monies from the Bidder.

  13. The Bidder, grants the Auction Company a standing authorization to charge the Bidders credit card for any and all costs, fees, buyers premiums, storage disposal fees as well as for any other costs, charges and/or fees incurred. We charge a $100 processing fee for processing credit card chargebacks that are ultimately reversed in our favor.

  14. The Auction Company will gladly ship items that can be sensibly shipped. There is a small packaging/handling fee of $5 per order that will be added to any shipping charges incurred, if shipping is desired. Shipping insurance is required for the total bid amount. All shipping, insurance charges and fees are the sole responsibility of the Bidder. We ship as a courtesy to you, and we are not responsible, under any circumstances, for any damages incurred to items during shipping. If we do not feel comfortable shipping an item or items, we reserve the right to contract out the shipping to the UPS Store, Mailboxes, Etc, or a similar service. All costs and fees will be the sole responsibility of the buyer.

  15. All applicable purchases will have 6% Michigan State sales tax added, unless a valid sales tax exemption form is on file with our company. No previously paid sales tax will be refunded in any circumstances.

  16. Payments: The Auction Company accepts cash, good checks,   Visa, Mastercard, American Express and Discover.

  17. Sellers may not bid on their own items for any reason whatsoever. If a Seller is found to have bid on their item(s), or had someone bid on their item(s) with the purpose of artificially inflating the price of an item(s), (this practice is known as shill bidding), that Seller will no longer be able to sell or buy on this site. We do have software that will determine and report common patterns of shill bidding, and all IP addresses are recorded. Shill bidding is a violation of various state and federal laws.

    18.   Credit cards  for purchases under $20 will be charged a $3  fee as  of  Sept 7th,2015......

How to sell on our site:

  1. You must first register as a bidder on our site, so that we have your full contact information.
  1. You must read and accept our rules and fee structure (below).
  1. You must call us, stop in or e-mail us with your online bidder  name  and request to be a seller.
  1. With the click of the mouse you will become a seller. Directions on how to list your items is available by phone or email. 
  1. Sell, Sell, Sell!

Rules: You must have a digital camera and be willing and able to offer potential bidders an honest and accurate description of any item listed, as well as provide an honest and accurate photo view of the item being sold.

No seller can list pistols, adult oriented items (other than Playboy magazines), used clothing (with the exception of shoes, coats and jackets) or anything illegal. Michigan Auction sales  can not and will not ship bullets of any type....It  is legal to sell them but they must be picked up in person at Michigan Auctions sales during normal business hours..... All sellers must accurately describe their items. If any item is shown to have been misrepresented (whether intentional or unintentional), the buyer will be given a full refund and the item will be returned and back charged to the seller. No refund of commissions or fees will be provided to a seller for a refund given in the case of a misrepresented item. Most recently, out of nearly 800 items, we had 2 lots returned. While everything is sold as-is and where-is, we all still owe it to the buyers to provide an honest accurate description of the item being sold.Item relist  will  be  done  for  3 weeks  after that  it is  up to seller to repost  any items  that  did not  sell. We advise  that sellers  rethink  lots  that  do not sell in  3 weeks.

Listings: Once you place a listing on the site, it can not be removed at anytime during the auction.

Contact Info: You can not include any contact info including email address, telephone number, name or address in your listings. Bidders can communicate with us and we will pass all messages on to the appropriate seller.

Reserves: Everything is in auction format and bidding starts at $3 on all items. However, each seller may have up to 3 of their items each week with a reserve price or a higher starting bid. The reserve price is hidden from buyers, the higher starting bid obviously is seen by buyers. To list an item with a reserve, place the following text at the end of your  listing "This item has a reserve. Please notify me by phone or email ASAP what the reserve price is. To list an item with a higher starting bid, place the following text at the end of your listing "This item has a starting bid of $xx.xx". Be sure to enter the actual amount of your starting bid. If you do not follow this format, your listing will be removed. If you wish to lower or drop a reserve on an item, you must do so BEFORE the auction ends. Once the auction ends, if an item did not meet the reserve, those bids are deleted, and gone forever. Reserve's must be in  by  Thursday nights at 8pm and will be added  before  noon Friday.

Sellers may not bid on their own items for any reason whatsoever. If a Seller is found to have bid on their item(s), or had someone bid on their item(s) with the purpose of artificially inflating the price of an item(s), (this practice is known as shill bidding), that Seller will no longer be able to sell or buy on this site. We do have software that will determine and report common patterns of shill bidding, and all IP addresses are recorded. Shill bidding is a violation of various state and federal laws.

Fees: There is no listing fee for your items at this time, a 25% commission charge, and a $1 "no-sale" fee and $1 reserve fee this no-sale fee is charged only if an item doesn't sell and is more than 10% of the number of listings you have. There are no other fees or charges. We take care of all shipping and other distribution of items to the buyers. 

 

·         Single items that sell for over $500 = Commission is reduced to 20%

·         Single items that sell for over $1000 = Commission is reduced to 17.5%

·         Single items that sell for over $2000 = Commission is reduced to 15%

·         Single items that sell for over $3500 = Commission is reduced to 12.5%

·         Single items that sell for over $5000 = Commission is reduced to 10%

·         Single items that sell for over $10,000 = Commission is reduced to 8%

Payments: Sellers will be paid, less fees and commissions, on the Tuesday following the pick-up period for the buyers. We reserve the right to return to the seller, and chargeback, any item which is not paid for by a bidder.

Seller pick-up: Sellers can pick up their online auction winnings until the 2nd Tuesday after the auction ends. That way each seller can pick-up, drop-off and get paid in one weekly trip. Any items left for more than 8 calendar days will be subject to the late pick-up buyers premium. Due to our live auction schedule, sellers can not pick-up or drop off on Saturday after 3pm.

All sold items must be dropped off at our store by on the Tuesday and Wednesday immediately following the auction end for distribution to the bidders. All items must be tagged with the corresponding lot number. Out of area sellers must mail their items to us in enough time so that they arrive to us by6 pm  Wednesday, immediately after the online auction ends. Due to space limitations, sold items can not be dropped off earlier than Friday. Due to our live auction schedule, sellers can not pick-up or drop off on Saturday after 3pm. If an item is not delivered to us for distribution by 3 pm Wednesday, and the bidder comes in to pick up that item, we will offer to ship the item to the bidder, at the sellers cost, the seller will also pay the $5 handling charge.
